Intellectual Property and Seed Governance in Agricultural Systems

Intellectual property in agricultural seeds encompasses a range of legal mechanisms—patents, plant variety protection and utility licences—designed to reward innovation in plant breeding while shaping access to germplasm. At the international level, agreements such as the WTO’s TRIPS provisions and the International Treaty on Plant Genetic Resources for Food and Agriculture establish frameworks that both enable rights‐holders to control new varieties and oblige contracting parties to facilitate farmers’ access and benefit sharing. National regimes often mirror these treaties, granting exclusive rights to breeders for a fixed term in exchange for variety registration and technical information disclosure. These rights intersect with corporate concentration in the seed sector, where merger and acquisition trends have consolidated control over elite genetics, raising concerns about reduced crop diversity, elevated seed prices and constraints on farmer‐led breeding. In response, alternative governance approaches have emerged. Seed commons initiatives and open‐source licences seek to safeguard cultivars as shared resources, permitting free exchange under copyleft‐style conditions. Responsible innovation frameworks call for early engagement of farmers, civil society and public institutions to reconcile commercial objectives with agrobiodiversity conservation and resilient cropping systems. Across scales, from village‐level community seed banks to global treaty bodies, the governance of seed knowledge and material reflects a balancing act between proprietary incentives and the collective imperatives of food security, cultural sovereignty and environmental sustainability.
