Summary
The process of European legal integration is driven by a dynamic interaction between national judiciaries and the supranational forum of the Court of Justice of the European Union (CJEU). National courts engage in a dialogue with the CJEU through procedures such as preliminary references, shaping the interpretation and application of EU law across member states. This judicial dialogue advances uniformity and compliance, yet it also encounters resistance from political actors and public opinion. Over time, the jurisprudence of the CJEU has evolved in an incremental, quasi‐constitutional manner—expanding the scope of EU competencies while remaining responsive to member state preferences. Simultaneously, domestic courts exercise a form of “shadow influence,” anticipating CJEU scrutiny and adapting national statutes accordingly. The interplay of legal reasoning, political contestation and public legitimacy underpins the complex architecture of European integration, with courts acting both as catalysts of deeper integration and as potential bottlenecks when legal mandates collide with national sovereignty or popular scepticism.
