Legislative Negotiations in European Union Governance

Legislative negotiations within the European Union engage three central actors—the European Commission, the Council of the European Union and the European Parliament—under the ordinary legislative procedure. This process combines formal readings with informal tripartite meetings known as trilogues, where institutional representatives negotiate compromises out of public view. Institutional balance is shaped by shifts in co-decision powers, qualified majority voting thresholds and the rotating Council Presidency, which can influence the timing and content of proposals. Negotiators rely on internal expertise from committee secretariats and external stakeholders, yet expertise is often politicised along party lines. Preparatory bodies and shadow meetings within the Parliament serve to build cohesive mandates, anticipating Council and Commission positions. At the same time, competing values of transparency and efficiency generate a persistent trade-off: greater openness may slow decision-making, while increased secrecy can undermine democratic accountability. Rising levels of polarisation and Euroscepticism have complicated consensus building, prompting scholars to model bargaining power both qualitatively and quantitatively. These insights deepen our understanding of how multi-level governance operates in practice, offering lessons for other supranational systems.
